Justice prosecutes Member of Parliament Gideon van Meijeren for incitement. These are two cases in which the FVD member suggested that violence against the government should and is even necessary.
With his statements, Van Meijeren was guilty of incitement to violence against the government, according to the Public Prosecution Service (OM).
The first incident is a speech by Van Meijeren during a farmers’ protest in Tuil. The MP told a crowd in July 2022 that farmers could violently resist the government, “should it proceed to expropriate farmers”. That speech was also shared online.
The second case revolves around statements in an interview published on the internet on November 13, 2022. Van Meijeren said he hoped for a revolutionary movement that would overthrow the government.
In the interview, Van Meijeren said that past examples show that such revolutions result in casualties, sometimes fatalities. The Member of Parliament said he hoped that such a revolution would proceed peacefully, but that he continued to hope for a revolution.
Wat is opruiing?
Van opruiing wordt gesproken als iemand anderen aanmoedigt om iets strafbaars te doen. Justitie hoeft niet te bewijzen dat iemand daadwerkelijk strafbare feiten heeft gepleegd als gevolg van de uitingen van een ander. Er is dus een groot grijs gebied. Een rechter kijkt daarom altijd goed naar de context waarin mogelijke opruiing plaatsvindt.
Public Prosecution Service emphasizes that statements may not conflict with the law
The Public Prosecution Service says that a politician has the task of raising issues of general interest, even if doing so hurts, shocks or worries others. But the judiciary also emphasizes that a politician should prevent his own statements from being contrary to the law and the basic principles of the rule of law.
Van Meijeren was called for an interrogation by the National Criminal Investigation Department during the investigation, but did not appear. It is not yet known when the lawsuit will be filed.
The FVD MP was convicted by the police judge in March this year for ignoring a red traffic light. He was given a community service order of sixty hours and a suspended prison sentence of one week. The judge revoked his driver’s license in 2021 because he refused to cooperate with a breath test. In 2010 and 2011 he was convicted of driving under the influence.
